Welcome to Aventus Health, an app powered by Aventus Medical Care, Inc.

This App allows us to provide you online clinic service, such as, but not limited to, online consultation, telemedicine and physician directory. Through Aventus Health.

TERMS AND CONDITIONS

Please read these TERMS AND CONDITIONS (T&Cs) prior to completing the registration for an account with Aventus Health. The following T&Cs shall govern the terms under which you may access and use the products of Aventus Health and the services associated with it. By registering to Aventus Health App, you accept and agree to be legally bound by the T&Cs. Please also read the Privacy Policy of Aventus Health (click here) before you use any portion of the Aventus Health Service. The Privacy Policy describes how your personal data is collected and processed when you use the Aventus Health Service. The Acceptable Use Policy defines the set of rules that you should comply with when using the Aventus Health App. If you do not understand or do not wish to be bound by the T&Cs or Privacy Policy, you should not access or use any portion of the Aventus Health Service.

These T&Cs shall be effective, valid and binding from the time you agreed to it and will exist up to the time that it is terminated by you or us, save for those provisions that will remain effective after termination as stated in these T&Cs, laws or regulations.

Aventus Health reserves the right to modify these T&Cs at any time without any advance notice. Any changes to these T&Cs will be effective immediately upon posting on this page, with an updated effective date. By accessing or using the Aventus Health Service after any changes have been made, you signify your agreement on a prospective basis to the modified T&Cs and all the changes. Be sure to turn to this page periodically to ensure familiarity with most current version of the T&Cs.

Under these T&Cs, the terms “Aventus Health”, “we”, “us”, and “our” refer to Aventus Medical Care, Inc. together with its employees, directors, affiliates, successor and assigns.

BASIC TERMS

By accepting the T&Cs, you represent that you are at least 18 years old to register for a Aventus Health account.

If you are a business entity, you also represent that you are duly authorized to do business and your employees, officers, representative and other agents accessing or using the Aventus Health Service are duly authorized to access and use the Aventus Health Service and to legally bind you to these T&Cs and all transactions conducted under your username and password.

REGISTRATION FOR AVENTUS HEALTH ACCOUNT

When you accept these T&Cs, you are setting up your Aventus Health that is associated with your email and Mobile number. 

You agree to provide all necessary information and render all reasonable assistance and cooperation that we may require in order to complete the verification. The information you provide will be used to determine if you are eligible to begin and/or continue to use your Aventus Health Account or the Aventus Health Service. We reserve the right to close, suspend or limit your access to your Aventus Health Account and/or Aventus Health Service in the event that we are unable to obtain or verify our information. All collection and use of your personal data by us is subject to the Privacy Policy of Aventus Health. 

You are responsible for providing accurate registration information and for keeping your registration information up to date, or notifying us in the event of changes. In addition, as certain Aventus Health Services may become available or procured  after registration or be offered only on selective basis or promotional basis, supplementary information may be required from your end in order to enable the relevant Aventus Health Services or avail of the Aventus Health Service.

Aventus Health reserves the right, at its sole discretion and without prior notice, to suspend, refuse or close Aventus Health accounts for any reason at any time. 

Aventus Health may withdraw or cancel Aventus Health accounts; and/or terminate a persons’s access from the Aventus Health App at any time due to the following reasons: any abuse of the Aventus Health App; any breach of the Aventus Health terms and conditions; and any behavior or action related to Aventus Health that involves theft, misconduct, or supplying false and misleading information.

You can opt to leave and delete the Aventus Health App for any reason at any time. By leaving and deleting the App, Aventus Health reserves the right to cancel your accounts.

AVAILABILITY

Unless otherwise stated, the services featured on Aventus Health are only available within the Philippines. All content is intended solely for the Philippine market. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of Aventus Health. Aventus Health does not warrant that the Aventus Health system will be uninterrupted, timely or error free, although it is provided to the best ability.

Aventus Health values your privacy and this policy is meant to help you understand how we protect the information you provide. Our people is working hard to ensure you remain in control of your data. What we collect and why.

We built this Aventus Health App to provide you with the most efficient services we can offer in the market, improve our services and personalize them to your needs to the extent possible. This App allows us to provide online clinic services and to interact with you directly.  But to do this we need the following information from your end:               

  • Your name
  • Your mobile number
  • Your email address

The above may include other health information such as:

  • Age, sex

These set of information will be used further for other purposes. Specifically, we collect your name, and to verify your identity and to reach out to you in cases of public service announcements. Collecting your contact details like mobile number or email allows us to send you confirmation of registration in this App, verify if clinic transactions are yours, as well as updates and materials you may like. For example, if there are updates in our services, you will know them with a notification sent via this App. Please note, we will only send you marketing materials if you give your specific consent, which you will see later on.

All those we collect from you are treated as private and confidential.

Reviewing, Updating, Removing and deleting your information

You can request to update and delete App account information by sending your request to our data protection officer, via __________________. You may also call us at +63_______________.

Note, however, that deleting your account information will automatically result in the deactivation of your access to this App.

If you want to withdraw your consent to our use and/or disclosure of your personal data for the delivery of Aventus Health Loading services, just bear in mind that we may no longer be able to serve you nor provide you with the products and services that you require.

When Aventus Health shares your information

Aventus Health will only share your information if:

You gave your consent; The processing of personal information is necessary and is related to the fulfillment of the business purpose. For instance, we may share your information to third party service providers for the purpose of improving our services. The processing is necessary for compliance with a legal obligation to which Aventus Health is subject, The processing is necessary to protect your vitally important interests, including life and health, The processing is necessary in order to respond to national emergency, to comply with the requirements of public order and safety, or to fulfill functions of public authority which necessarily includes the processing of personal data for the fulfillment of its mandate; or The processing is necessary for the purposes of the legitimate interests pursued by Aventus Health or by a third party or parties to whom the data is disclosed, except where such interests are overridden by fundamental rights and freedoms of the data subject which require protection under the Philippine Constitution.

To whom we may Disclose

Your information may be disclosed subject to the above stated conditions only and the requirements of the Data Privacy Act to:

Partner Entities with which you provided your consent separately, including our HMO Affiliates. Employer, if consultation (through TelAventus MD) is done upon the endorsement or as a requirement of your Company Third Party Service providers necessary for the improvement of our services in relation to the purposes of Aventus Health App. Courts, Law Enforcement Authorities and Regulators but only upon their lawful orders With Lawyers or any person whenever there is a need to protect the rights of Aventus Health; provided that the information is absolutely necessary.

We build security into our services to protect your information. We strive to build the best security precautions to ensure that the information you provide is protected against unauthorized or unintended access. We can assure you that internationally acceptable standards are in place so you will feel comfortable trusting us with your data.

Please note, The information entered may be extended to our partner companies, organizations, or agencies including their sub-contractors or prospective business partners that act as our service providers, contractors, professional advisers who help us enhance our products and services. An example would be our couriers for bill delivery and our customer contact centers for our hotline operations. We also work with third parties, including banks or financial institutions, to enable them to facilitate payments for services we offer using Aventus Health. In this case, a third party may share information about you with us. Please note that the banks / financial institutions have their own privacy policies, and Aventus Health cannot be held responsible for their operations, including, but not limited to, their information practices.

Retention

Your information is retained for the period for as long as the purpose for which the personal data was collected continues.

We will destroy the personal data thereafter, unless it is necessary to retain the personal data longer for our satisfaction and compliance of legal, regulatory, or accounting requirements, or to protect our interest.

Data Subject Rights

You hereby warrant that you understand the following rights as data subject as provided under the applicable Data Privacy Frameworks, including the Data Privacy Act of 2012:

  1. Right to be informed whether Personal data is being processed.
  2. Right to object to the collection and processing of personal data.
  3. Right to reasonable access to your Personal Data including the content of the data that was processed, sources from which Personal Data were obtained, names and addresses of recipients, manner by which Personal Data was processed, reasons for the disclosure of Personal Data to recipients, if any, information on the automated processes where Personal Data will be made as the sole basis of any decision that significantly affects or will affect you, the designation, name, address of Aventus
  4. Right to dispute the inaccuracy or error in Personal Data and have Aventus correct the same
  5. Right to suspend, withdraw or order the blocking, removal or destruction of Personal Data from Aventus Health filing system; and
  6. Right to be indemnified for any damages sustained due to any inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of Personal Data

INDEMNIFICATION

Indemnification. You agree to indemnify and hold Aventus Medical Care, Inc. its parent, affiliates, the officers, directors, agents, joint venturers, and employees harmless from any claim or demand (including attorneys’ fees) arising out of your breach of this Agreement or your use of Aventus Health services.

DISPUTES WITH AVENTUS

If you think we have made an error, write to us at ______________ or email us at ____________________. In your correspondence, you must give us information sufficient to identify you, your account, and the transaction on which you believe an error occurred. You must contact us within 30 days after the transaction occurred. Within 90 days of receiving your request, we must either correct the error or explain to you why we believe the transaction was correct.

LIMITATIONS OF LIABILITY

IN NO EVENT SHALL WE, OUR PARENT, AFFILIATES, THE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES AND SUPPLIERS OF AVENTUS OR OUR PARENT BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH AVENTUS HEALTH APP, AVENTUS HEALTH SERVICES, OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE. OUR LIABILITY, AND THE LIABILITY OF OUR PARENT, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE ACTUAL AMOUNT OF DIRECT DAMAGES.

NO WARRANTY

AVENTUS HEALTH SERVICES ARE PROVIDED “AS IS” AND WITHOUT ANY REPRESENTATION OF WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY. AVENTUS, OUR PARENT, AFFILIATES, THE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES AND SUPPLIERS OF AVENTUS OR OUR PARENT SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Aventus does not guarantee continuous, uninterrupted or secure access to any part of Aventus Health services, and operation of our App may be interfered with by numerous factors outside of our control.

FORCE MAJEURE

We shall not be liable for delays, failure in performance or interruption of service which result directly or indirectly from any cause or condition beyond our reasonable control, including but not limited to, any delay or failure due to any act of God, act of civil or military authorities, act of terrorists, civil disturbance, war, strike or other labor dispute, fire, interruption in telecommunications or Internet services or network provider services, failure of equipment and/or software, other catastrophe or any other occurrence which is beyond our reasonable control and shall not affect the validity and enforceability of any remaining provisions.

DISPUTE

Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally referred to the exclusive and sole jurisdiction of the courts of Makati City, Philippines.

TIME LIMITATION ON CLAIMS

You agree that any claim you may have arising out of or related to your relationship with Betur Inc. must be filed within one year after such claim arose; otherwise, your claim is permanently barred.
